There is a post on the apple forums that announces a server overload resulting from massive downloads of the 2.2 upgrade software. The support tech advises to keeping trying over the next 48 hours.

im having the same problem and its gettin annoyin, im about to call apple or somtin cuz i did not just drop 10 bucks for an update cant even use

Same shit happened to me … smh the ipod help number is 1800 692 7753 .. if that helps any.. they take forever nd 2moro to answer , but they are a great help….. sometimes.
